Please read these Coach And Four® Terms and Conditions of Use (“Terms”) carefully before using our website (the “Site”) or making any purchases from Coach And Four® (“we,” “us,” or “our”). The Site is owned and operated by Coach And Four® Shoes, Sandals, Boots, Heels.

By accessing or using the Site or making any purchases, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not access or use the Site.

1. Basic Terms

You must be at least 18 years old or have permission from a parent or guardian to use this Site. By agreeing to these Terms, you state that you are at least 18 years old or have permission from a parent or guardian.

This Site is intended solely for users who reside in the United States or Canada. We make no claims regarding access or use of the Site or its content outside of the United States and Canada.

You agree not to use the Site or any content contained herein for any illegal purpose. You agree to use the Site legally under U.S. and Canadian laws and will not use the Site for the submission, proliferation, publication or other dissemination of content that is illegal under criminal or other statutory or common law.

2. Account Registration

Certain sections and features of the Site permit or require you to register or create an account to participate, request information, apply for a job or purchase products (an “Account”). You agree to provide true, current and complete information about yourself, or if registering on behalf of your company or another entity, that entity, within the registration process. You also agree to promptly update your information if it changes.

If there is reason to believe the personal information you provide is incorrect, inaccurate, outdated or incomplete, we may terminate your access to the Site and any related accounts. However, we are not obligated to verify the accuracy of personal information and disclaim any liability for your provision of incorrect information.

You are solely responsible for maintaining the security and confidentiality of your login credentials and agree not to share these details with any third party. You will immediately notify us if you suspect unauthorized access to or use of your Account.

We reserve the right to refuse, disable or terminate your registration and your access to all or part of the Site if we believe you have violated these Terms or applicable law. After an Account cancellation, you may no longer have access to content, products, services and communications you had access to before.

3. User Content

If you submit, transmit or otherwise make available content like images, videos, feedback or information (“User Content”) on or through the Site, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify and distribute your User Content on the Site and in any related materials produced by Coach And Four®.

You warrant that you have all necessary rights to grant us this license for any User Content you share and that such User Content is accurate and complies with applicable laws. You are responsible for all User Content you provide.

In addition, information you submit or post in community discussions like forums, blogs, reviews or social media may be viewed publicly and should not be considered private. Any ideas, suggestions or feedback you provide regarding Coach And Four® is voluntary and we may use such feedback without compensation or obligation to you.

4. Purchases

You agree that all purchases of products, services, gift cards and donations made through the Site are final under the applicable Terms of Sale. Please refer to our Returns & Exchange Policy for details on eligible items for return and the return process.

The availability of products on the Site does not imply that they are or will be available in every Coach And Four® retail location. Likewise, items found in-store may not be available online. Prices do not include sales tax, which will be added at checkout where required by law. We reserve the right to revise prices at any time.

5. Usage Rules

You agree not to:

Abuse, harass, threaten, stalk, defame or defraud users of the Site
Impersonate any person or entity or provide false information on the Site
Solicit personal data from minors or exploit minors in any way
Post or transmit offensive or obscene content
Engage in conduct that is fraudulent, unlawful or harmful to Coach And Four® or others
Violate terms associated with user accounts
Violate intellectual property rights
Modify, adapt, reverse engineer or create derivative works from the Site
Remove or alter Site copyright notices, trademarks or other proprietary rights notices
Post spam, advertising, chain letters or pyramid schemes
Distribute viruses or malware
Harvest, scrape or collect user data without explicit consent
Access restricted user data not belonging to you
Probe, scan or test Site vulnerability without authorization
Overwhelm or interfere with the Site

We grant you a limited license to access and use the Site and content for your own personal use. You agree not to download, license, sell, transfer, modify or reuse any portion of the Site or its offerings, except as expressly allowed in writing.

For your convenience, the Site may contain links to third-party websites that are not controlled by Coach And Four®. We are not responsible for third party sites, services or content. Having a link or advertisement does not imply endorsement. You agree that we are not responsible for any aspect of a third-party site including its collection or handling of personal data. If you choose to access any third party sites linked from Coach And Four®, you do so at your own risk.

7. Intellectual Property Rights

All content available through the Site, including but not limited to text copy, photographs, graphics, images, illustrations, software, audio clips and video clips, trademarks and logos is owned by Coach And Four® or its content suppliers. Content is protected in the United States and other countries and may not be reproduced, published, distributed, modified or exploited without our permission.

The Coach And Four® name and logo are registered trademarks. All custom graphics, icons, logos and service names used on or in connection with the Site are trademarks, registered trademarks or trade dress of Coach And Four®. You may not alter or obscure trademarks.

8. Disclaimers

Information provided on the Site is for general guidance and is not professional advice. We endeavor to keep Site content accurate but cannot guarantee the completeness or accuracy of any product specifications or other information. Coach And Four® makes no warranties or representations about the Site or its content.

You agree to defend, indemnify and hold harmless Coach And Four®, its parents, subsidiaries and affiliated companies and contractors and their employees from any and all claims, liabilities, damages, losses and expenses arising from your access and use of the Site or violations of these Terms. Coach And Four® reserves the right, at our expense, to assume exclusive defense and control of any indemnification matter which is subject to indemnification and you agree to cooperate with us. Your obligation to indemnify us remains even after site termination.

10. Choice of Law and Jurisdiction

These Terms are governed exclusively by the laws of the United States and the State of Oregon excluding conflicts of law rules. For any disputes not subject to arbitration you expressly consent to personal jurisdiction and venue in the state and federal courts located in Portland, Oregon. Any cause of action you may have in connection with your use of the Site must be commenced within one (1) year after the claim or cause of action arises.

11. Content Guidelines

Content submitted by users, whether articles, images, videos, feedback or other information must be:

Truthful with no intent to mislead or deceive
Lawful under applicable laws and regulations
Respectful of individuals’ privacy rights
Relevant to the applicable discussion and appropriate for readers

User Content should not:

Promote hate, violence, illegal acts or harm against others
Infringe copyright, trademark or other legal rights of others
Reveal trade secrets or breach contracts or fiduciary duties
Promote or endorse false information or illegal activities
Contain private/confidential information without consent or legal basis
Contain viruses or corrupted files
Excessively advertise commercial products or services
Violate any additional rules specific to a community discussion or feature

We reserve the right to moderate User Content before it is published and to remove any submissions that do not meet these Content Guidelines. Repeat violators may have their Account privileges revoked.

12. DMCA Copyright Policy

Coach And Four® respects others’ intellectual property rights. Upon proper notice, we will promptly remove any content from the Site that infringes on the copyright rights of others and terminate repeat infringers’ access to the Site per our DMCA Copyright Policy. Please submit infringement notices to Coach And Four’s Copyright Agent:

Notifications must provide:

Identification of the copyrighted work claimed infringed
Identification of the infringing material
Contact details for the notifying party
A statement alleging in good faith the infringing use is not authorized
A sworn statement the information is accurate and the notifying party has rights to proceed

13. Termination

We may modify, suspend or terminate your access to and use of the Site at any time without notice and may delete or disable your account so that any associated content you submitted is no longer available on the Site. Grounds for termination include violation of these Terms, extended inactivity or superseding of the Terms by an updated version.

Coach And Four®, in its sole discretion, may allow your access to be reinstated upon acceptance of a new Terms of Use. Certain sections of these Terms survive termination, such as indemnification, applicable law and complete agreement.

14. Entire Agreement

These Terms constitute the entire agreement between you and Coach And Four® related to use of the Site and supersede any prior understandings. Coach And Four® may modify these Terms from time to time by posting an updated version. Updated Terms become effective immediately upon posting to the Site.

If any part of the Terms is held invalid or unenforceable the rest of the Terms and remaining obligations will remain valid and enforceable. The failure to exercise rights under the Terms does not waive any right to later enforce those rights. Section headings are for reference only and do not define, limit or interpret Terms.
